New Chief Justice Sworn in for Probate & Family Court

Chief Justice for Administration and Management Robert A. Mulligan administered the oath of office for Chief Justice of the Probate & Family Court to Judge Paula M. Carey on September 28, 2007, at the Probate & Family Court’s Fall Judicial Conference. In addition to all of that Court’s judges, Chief Justice Carey’s family and several colleagues from the Norfolk County Probate & Family Court attended the ceremony.

Prior to the swearing in, Chief Justice Mulligan commended the substantive contributions to the Probate & Family Court made by retiring Chief Justice Sean M. Dunphy and recognized him as “a consensus builder who has led with quiet dignity and intelligence.”

He noted that Judge Carey is widely respected by her court colleagues and the bar. “Judges, administrators, court officers, probation officers, and practitioners all hold her in the highest esteem,” he said. “She brings focused energy and practical enthusiasm to our quest for new solutions. Her energy and enthusiasm are grounded in a foundation of knowledge, integrity, respectful commitment to her colleagues and deep personal concern for solving family issues.”

Chief Justice Carey thanked Chief Justices Dunphy and Mulligan, her colleagues, and her family for their support. She committed to work tirelessly in advancing the interests of the Probate & Family Court and shared some of her ideas for implementing her vision for a responsive, effective court.

Definition:
The total of all assets, all debts and other obligations of an individual. At the time of death the total amount of benefits (life insurance, annuity and retirement benefits) to be paid to beneficiaries are often also considered part of the estate for Federal Estate Tax purposes

Definition:
A provision of a will or trust that disinherits a person in the event that he/she challenges the terms of the will or trust. Sometime called a No-Contest Clause.

Informed Consent

Definition:
An authorization to proceed by a person who has been given and understands all of the relevant facts.
